Employment legislation and policies


Employment in the State Service is governed by legislation and policies that range from the State Service Act 2000 through to individual Agency policies. Each of these documents help to determine the way the State Service conducts business, and the expectations on each employee from trainees to Officers.

The State Service Act 2000

The State Service Act 2000 (the Act) is part of the employment law framework the State Service operates within. The Act applies to all Officers and employees of the State Service and:

  • details the requirements for establishing Departments and Authorities
  • sets out the powers of the Minister (also known as the Employer), the Head of the State Service, Heads of Agencies, Senior Executives, and holders of prescribed offices
  • sets the criteria for employment, promotion, transfer and other employment-related actions
  • is home to the Code of Conduct, and State Service Principles.

Code of Conduct

State Service employees must abide by the Code of Conduct, which sets out how they are expected to:

  • behave at all times during the course of their employment
  • treat others
  • use information and resources they have access to.

State Service Principles

The State Service Principles are similar to a set of values or standards, and represent the minimum responsibilities of all employees and Officers. The Principles are applied to all activities and decisions made within an Agency, and it is the responsibility of the Head of Agency to promote and uphold the Principles.

Pay and conditions

Pay and conditions within the State Service are determined by awards and agreements. Most employees are covered by the Tasmanian State Service Award however depending on your position your salary and conditions may be covered by a different award, or an agreement.

Awards and agreements detail all the conditions which will apply to your employment, including:

  • salary rates
  • leave entitlements
  • conditions of work such as hours of work
  • allowances
  • any qualifications required.
